GTC

Please note the following points to ensure that the collaboration is clear and trusting from the outset:

Scope of application

These General Terms and Conditions (GTC) apply to the business area of Laura Trinkler (hereinafter referred to as “Counselor”), www.lauratrinkler.ch.

The fields of activity include psychological counseling (online, on the phone). These GTC apply to the above-mentioned areas as well as to the other services that the sole proprietorship provides directly and indirectly to the client.

Conclusion of contract

The contract is concluded when an order is placed, an appointment is made or services/products are purchased by the client. This can be done verbally or in writing. By registering, the client accepts the general terms and conditions.

The counselor is entitled to refuse a consulting contract without giving reasons if the necessary relationship of trust cannot be expected, if the counselor cannot or may not provide advice due to her specialization or for legal reasons, or if there are reasons that could put her in conflict of conscience. In this case, the counselor's fee claim for the services rendered up to the refusal of psychological counseling remains unaffected.

 

Prices

Unless otherwise quoted, the prices published on the website at the time the contract is concluded shall apply to all services and offers. All prices are quoted in Swiss francs (CHF), excluding any applicable value added tax (VAT).

The counselor reserves the right to change prices at any time. The prices valid at the time the contract is concluded shall apply.

The rates for sessions include preparation and follow-up time. The duration of a session can be adjusted individually and will be charged according to the actual time spent. If the counseling session takes place at a location chosen by the client, additional costs will be incurred for travel to and from the location by the counselor. These are charged individually according to distance and time spent. Expenses incurred by the client, such as telephone calls, e-mails, reports, etc., are charged according to the actual time spent.

Payment

Payment is made directly when the service is booked by card payment or bank transfer.

Receipts for the consultations and services provided are issued monthly and sent by e-mail. The health costs you pay yourself are tax-deductible under certain conditions.

 

Cancellations and changes to appointments

Cancellations or changes to appointments for psychological counseling and other services (regardless of the reason) are subject to the following terms:

  • Appointments can be rescheduled free of charge up to 24 hours (working days) before the scheduled time.

  • For cancellations made up to 24 hours (working days) before the appointment, a processing fee of CHF 15 will be charged.

  • Changes or cancellations made less than 24 hours (working days) before the appointment will be charged in full.

  • Changes and cancellations must be communicated to the counsellor via the contact form on the website or by email to info@lauratrinkler.ch.

Changes or cancellations made by the counsellor will not be charged. Any changes or cancellations initiated by the counsellor will be communicated to the client via a suitable means of communication (email, phone).

 

Reminder fees and debt collection

In the event of late payment, the counselor reserves the right to charge reminder fees. The reminder fees are determined as follows:

  • No fee will be charged for a first payment reminder.

  • A fee of CHF 10 will be charged for the first reminder.

  • A fee of CHF 20 will be charged for a second reminder.

If payment is still not made after the second reminder, the counselor reserves the right to take legal action and hand over the claim to a debt enforcement office. The resulting costs, including the fees of the debt collection office, shall be borne by the client. In any case, the client will be informed of the status of the claim and the forthcoming steps in good time.

 

Billing via health insurance

Psychological counseling is not billed via basic health insurance. The advantage of being a self-payer is that no prescription from a doctor is required and the health insurance company does not have to be involved either.

It is the client's responsibility to find out in advance from their health insurance company whether the counselor's services are covered by their supplementary insurance. Each health insurer only reimburses treatments in accordance with its benefits catalog.

Success of counseling

The counselor cannot guarantee the desired or planned success or the achievement of agreed goals in the joint work. Counseling is a free, active and self-responsible process in which the counselor is available to the client as a process facilitator. Both parties work to the best of their knowledge and ability to achieve successful counseling. To this end, the counselor uses all the counseling experience and communication methods available to her.

It is the client's responsibility to express their concerns and expectations as well as their wishes and criticisms. The goals of the counseling are discussed and determined together. Psychological counseling requires the willingness to actively participate.

 

State of health and responsibility of the client

The client assures that he/she does not suffer from any illness or disorder that impairs his/her legal capacity or currently prevents psychological counseling for medical-psychological reasons. If psychotherapy or psychiatric treatment is currently being carried out or is advisable due to the client's state of health, the client assures that he/she will inform the counselor immediately and that the psychotherapist is permanently informed about the psychological counseling (goals, type, topics, etc.) and has agreed to this counseling.

Duration and termination of counseling

The duration of counseling depends on the needs of the client. There is no specific hourly quota that must be used. However, in order to achieve certain goals, counseling should take place over several sessions. Counseling can be terminated at any time without giving reasons at the end of a counseling session, either verbally or informally by email with 24 hours' notice. Ideally, a final session should be held at the end of the counseling process to evaluate the overall process.

 

Liability

The counselor carries out all assignments with the greatest possible care and the necessary quality. However, the counselor cannot accept any liability for the outcome of her work and the subjective success expected cannot be guaranteed. Psychological counseling is not a substitute for examination, treatment or therapy by a doctor or psychotherapist. Psychotherapy is used to treat a mental illness. What is considered a mental illness or disorder is clearly defined in the internationally recognized classification systems (e.g. ICD or DSM).

Claims for damages of any kind are expressly excluded. All insurances are the responsibility of the client.

 

Confidentiality and professional secrecy

The counselor undertakes to maintain confidentiality towards third parties. This means that all services with individuals are subject to confidentiality. The duty of confidentiality begins with the first contact. Information may only be disclosed to third parties if the client has given his/her prior written consent. In the event of the announcement of suicidal acts and a lack of ability/willingness to contact a specialist, therapist or clinic, the counselor will immediately involve the relevant authorities in order to avert any danger to the client. In order to ensure the quality of her work, the counselor may reflect on the counseling situation anonymously in supervision. The client should always be aware that the transmission of information via the Internet and other electronic means entails certain security risks. The counselor cannot guarantee the security of information transmitted in this way.

Documentation and data protection

The counselor documents and archives the course and relevant findings of all counseling sessions. The counselor also stores personal data of the client to the extent necessary for invoicing and accounting purposes. The counselor undertakes to keep all documents accessible only to her. The client agrees to the collection and archiving of the relevant data.

Changes to the General Terms and Conditions

The counselor reserves the right to change these General Terms and Conditions at any time. The new version shall enter into force upon publication on the website www.lauratrinkler.ch. The version of the GTC in force at the time the contract is concluded shall apply to the client. Unless the client has agreed to a newer version of the GTC.

 

Place of jurisdiction

These GTC are subject to Swiss law. Unless mandatory statutory provisions take precedence, the court at the registered office of the company shall have jurisdiction.
